Privacy Protection Policy

  1. May 23, 20151. Dayworks, Inc. (“Dayworks,” “our,” “we” or “us”) is deeply committed to protecting your privacy, and this Privacy Protection Policy describes how we collect, store, and use information relating to you in connection with our Services (the “Information”). By using the Services, you consent to the use of your Information as described in this Privacy Protection Policy. For your reference, any capitalized terms not defined in this Privacy Protection Policy shall have the meaning ascribed to it in Dayworks’ Terms of Use, viewable at www.dayworks.net.
  2. Here is the Information we store and track:
    • Information you voluntarily provide Dayworks: Mobile Number, Email Address, Credit Card and related information, user last and first name, work skills, information on trade licenses and insurance, your biography, photographs, and review and ratings.
    • Information we collect from your interaction with Dayworks App: your device ID, your real time geo-location, your internet IP address, access to working files on your device, metadata, and other usage details pertinent to Dayworks.
  3. To the greatest extent possible, Dayworks will only ever use your Information to ensure the continued operation of provision of the Services. We will NEVER sell or license your Information to third parties. In limited situations, we may use your Information in an aggregated and totally anonymized manner (such as in conjunction with an analytics service like Google Analytics) to monitor and analyze our customers’ use of the Services. With your consent, we may also use your Information to contact you to further discuss your interest in the Services, and to send you limited marketing information about us and our business partners. As a generally matter, we will not disclose your Information to third parties that we do not have a business contract with (i.e. “Non-Business Partners”). We will only disclose your Information to Non-Business Partners where we have a good faith reason to believe that disclosing this Information is necessary to protect our legal rights, to prevent the commission of a violent crime, or where disclosure is required by law, such as pursuant to a court’s order. By providing your mobile phone number, you expressly consent to receive text messages from us relating to our Services at that number.
  4. With respect to real time geo-location data we track through your mobile device, we use that geo-location information as follows:
    • If you are using the Services as a Boss: We use your geo-location information to calculate the distance from you to nearby Workers for hire.
    • If you are using the Services as a Worker: We use your geo-location information to show you the location of nearby jobs posted by Bosses and to allow bosses to see your location, when determining if you can be hired and once you are hired. We also disclose your geo-location information to Bosses in your area, in order to help them locate you and retain your services. Such disclosure of geo-location information is limited to bosses who are browsing workers for hire.
    • You may at any time no longer allow our Services to use your location by turning off this feature on your mobile device by turning your beacon “Off”.
  5. All communications between your mobile device and our servers is encrypted and/or password protected to safeguard and protect your data, especially credit card transitions which are encrypted to the highest standard we can reasonably provide. However it is important that you understand no information transmitted over the internet is 100% secure.
  6. If at any time you wish to delete your account with Dayworks, you can do so from our menu. When we delete your account, we strive to also delete any Information that may be used to identify you personally (i.e. “Personally Identifiable Information”) from our servers. Please note, however, that it may not be possible to completely delete all of your Personally Identifiable Information due to technological and/or legal constraints. While your transaction history will remain on our servers, it will become anonymous.
  7. We use the following contracted services which host and/or analyze your data as a necessary part of our business at Dayworks. Namely:
    • Amazon Web Services to host our servers
    • PiWick to analyze the data so we can improve our services to you and
    • Pay Pal Merchant Services to process payments.
    • These third-party business partners may occasionally have access to your Information in the course of providing us with their services. We chose these business partners on a number of business factors including their respective privacy policies. If you have further privacy concerns we recommend you also review the privacy policies of these vendors yourself.
  8. Please note that we may also disclose your Information in connection with a corporate re-organization, a merger or amalgamation with another entity, or a sale of all or a substantial portion of our assets or stock. In such an event, however, the Information disclosed will continue to be used only for the purposes permitted by this Privacy Protection Policy by the entity acquiring the Information.
  1. We do not knowingly collect information about children under the age of 13. This is because the Services are meant to be used only by individuals over 18 years of age.
  2. You understand that you will be able to voluntarily share Information about yourself with other individuals through use of the Services, including, but not limited to, your name, mobile number, photographs of yourself, and your real time geo-location. The privacy policies of these third parties are not under our control and may differ from ours. Therefore, the use of any Information you provide to a third party will be governed solely by your independent agreement with such third party.
  3. We reserve the right to change or modify this Privacy Protection Policy at any time. If we decide to change this Privacy Protection Policy in the future, we will post or provide you with appropriate notice. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted, and any material changes will become effective 30 days from their posting on www.dayworks.net or via email to your listed email address. Your continued use of the Services after any changes become effective signifies your acceptance of such changes.
